Computer Hacker Laws must be passed to address the increase in the number and types of computer crimes. Over the last twenty years, a technological revolution has occurred as computers are now an essential element of today's society. Large computers are used to track reservations for the airline industry, process billions of dollars for banks, manufacture products for industry, and conduct major transactions for businesses because more and more people now have computers at home and at the office. People commit computer crimes because of society's declining ethical standards more than any economic need. According to experts, gender is the only bias. The profile of today's non-professional thieves crosses all races, age groups and economic strata. Computer criminals tend to be relatively honest and in a position of trust: few would do anything to harm another human, and most do not consider their crime to be truly dishonest. Most are males: women have tended to be accomplices, though of late they are becoming more aggressive. Computer Criminals tend to usually be between the ages of 14-30, they are usually bright, eager, highly motivated, adventuresome, and willing to accept technical challenges.(Shannon, 16:2) It is tempting to liken computer criminals to other criminals, ascribing characteristics somehow different from 'normal' individuals, but that is not the case.(Sharp, 18:3) It is believed that the computer criminal often marches to the same drum as the potential victim b ut follows and unanticipated path.(Blumenthal, 1:2) There is no actual profile of a computer criminal because they range from young teens to elders, from black to white, from short to tall. Definitions of computer crime has changed over the years as the users and misusers of computers have expanded into new areas. When computers were first introduced into businesses, computer crime was defined simply as a form of white-collar crime committed inside a computer system.(2600:Summer 92,p.13) Some new terms have been added to the computer criminal vocabulary. Trojan Horse is a hidden code put into a computer program. Logic bombs are implanted so that the perpetrator doesn't have to physically present himself or herself. (Phrack 12,p.43) Another form of a hidden code is salamis. It came from the big salami loaves sold in delis years ago. Often people would take small portions of bites that were taken out of them and then they were secretly returned to the shelves in the hopes that no one would notice them missing.(Phrack 12,p.44) Congress has been reacting to the outbreak of computer crimes. The U.S. House of Judiciary Committee approved a bipartisan computer crime bill that was expanded to make it a federal crime to hack into credit and other data bases protected by federal privacy statutes.(Markoff, B 13:1) This bill is generally creating several categories of federal misdemeanor felonies for unauthorized access to computers to obtain money, goods or services or classified information. This also applies to computers used by the federal government or used in interstate of foreign commerce which would cover any system accessed by interstate telecommunication systems. Computer crime often requires more sophistications than people realize it.(Sullivan, 40:4) Many U.S. businesses have ended up in bankruptcy court unaware that they have been victimized by disgruntled employees. American businesses wishes that the computer security nightmare would vanish like a fairy tale. Information processing has grown into a gigantic industry. It accounted for $33 billion in services in 1983, and in 1988 it was accounted to be $88 billion. (Blumenthal, B 1:2) All this information is vulnerable to greedy employees, nosy-teenagers and general carelessness, yet no one knows whether the sea of computer crimes is only as big as the Gulf of Mexico or as huge as the North Atlantic. (Blumenthal,B 1:2) Vulnerability is likely to increase in the future. And by the turn of the century, nearly all of the software to run computers will be bought from vendors rather than developed in houses, standardized software will make theft easier. They include things like health and life insurance, pensions, time off with pay, and child-care assistance. Most full-time employees in the United States receive benefits. Virtually all employers offer some health insurance coverage. Employee benefits account for between 33% 40% of wages and salaries (or about 28% of total payrolls). Pay for time not worked is the most costly benefits, because of the large amount of time off employees. Compensation is a primary motivator for employees. People look for jobs that not only suit their creativity and talents, but compensate them-both in terms of salary and other benefits-accordingly. Compensation is also one of the fastest changing fields in Human Resources, as companies continue to investigate various ways of rewarding employees for performance. It is important for small business owners to understand the difference between wages and salaries. A wage is based on hours worked. Employees who receive a wage are often called non-exempt. A salary is an amount paid for a particular job, regardless of hours worked, and these employees are called exempt. The difference between the two is carefully defined by the type of position and the kinds of tasks that employees perform. In general, exempt employees include executives, administrative and professional employees, and others as defined by the Fair Labor Standards Act of 1938. These groups are not covered by minimum wage provisions. Non-exempt employees are covered by minimum wage as well as other provisions. It is important to pay careful attention to these definitions when determining whether an individual is to receive a wage or a salary. Improper classification of a position can not only pose legal problems, but often results in employee dissatisfaction, especially if the employee believes that execution of the responsibilities and duties of the position warrant greater compensation than is currently awarded. When setting the level of an employees monetary compensation, several factors must be considered. First and foremost, wages must be set high enough to motivate and attract good employees. They must also be equitable-that is, the wage must accurately reflect the value of the labor performed. In order to determine salaries or wages that are both equitable for employees and sustainable for companies, businesses must first make certain that they understand the responsibilities and requirements of the position under review. The next step is to review prevailing rates and classifications for similar jobs. This process requires research of the competitive rate for a particular job within a given geographical area. Wage surveys can be helpful in defining wage and salary structures, but these should be undertaken by a professional (when possible) to achieve the most accurate results. In addition, professional wage surveys can sometimes be found through local employment bureaus or in the pages of trade publications. Job analysis not only helps to set wages and salaries, but ties into several other Human Resource functions such as hiring, training, and performance appraisal. As the job is defined, a wage can be determined and the needs for hiring and training can be evaluated. The evaluation criteria for performance appraisal can also be constructed as the specific responsibilities of a position are defined. Other factors to consider when settling on a salary for a position include Availability of people capable of fulfilling the obligations and responsibilities of the job, Level of demand elsewhere in the community and/or industry for prospective employees, Cost of living in the area, Attractiveness of the community in which the company operates, Compensation levels already in existence elsewhere in the company. There are many federal, state, and local employment and tax laws that impact compensation. These laws define certain aspects of pay, influence how much pay a person may receive, and shape general benefits plans. The Fair Labor Standards Act (FLSA) is probably the most important piece of compensation legislation. Small business owners should be thoroughly familiar with it. This act contains five major compensation laws governing minimum wage, overtime pay, equal pay, recordkeeping requirement, and child labor, and it has been amended on several occasions over the years. Most of the regulations set out in the FLSA impact non-exempt employees, but this is not true across the board. The Equal Pay Act of 1963 is an amendment to FLSA, which prohibits differences in compensation based on sex for men and women in the same workplace whose jobs are similar. It does not prohibit seniority systems, merit systems, or systems that pay for performance, and it does not consider exempt or non-exempt status. In addition, the United States government has passed several other laws that have had an impact, in one way or another, on compensation issues. These include the Consumer Credit Protection Act of 1968, which deals with wage garnishments; the Employee Retirement Income Security Act of 1974 (ERISA), which regulates pension programs; the Old Age, Survivors, Disability and Health Insurance Program (OASDHI), which forms the basis for most benefits programs; and implementation of unemployment insurance, equal employment, workers comp, Social Security, Medicare, and Medicaid programs and laws. For the most part, traditional methods of compensation involve set pay levels (wage or salary) with regular increases. Increases can be given for a variety of reasons, but are typically given for promotions, merit increases, or cost of living increases. The Hay Group points out that there is less distinction today between merit increases and cost of living increases: Because of the low levels (3 to 4 percent) of salary budget funding, most merit raises are perceived as little more than cost of living increases. Employees have come to expect them. This base pay system is one that most people are familiar with. Often, it includes a set salary or wage, a set schedule for merit increases, and a set benefits package. Benefits are an important part of an employees total compensation package. Benefits packages became popular after World War II, when wage controls made it more difficult to give competitive salaries. Benefits were added to monetary compensation to attract, retain, and motivate employees, and they still perform that function today. They are not cash rewards, but they do have monetary value (for example, spiraling health care costs make health benefits particularly essential to todays families). Many of these benefits are nontaxable to the employee and deductible by the employer. Many benefits are not required by law, but are nonetheless common in total compensation packages. These include health insurance, accidental death and dismemberment insurance, some form of retirement plan (including profit-sharing, stock option programs, 401(k) and employee stock ownership plans), vacation and holiday pay, and sick leave. Companies may also offer various services, such as day care, to employees, either free or at a reduced cost. It is also common to provide employees with discounted services or products offered by the company itself. In addition, there are also certain benefits that are required by either state or federal law. Federal law, for example, requires the employer to pay into Social Security, and unemployment insurance is mandated under OASDHI. State laws govern workers compensation. As businesses change their focus, their approach to compensation must change as well. Traditional compensation methods may hold a company back from adequately rewarding its best workers. When compensation is tied to a base salary and a position, there is little flexibility in the reward system. Some new compensation systems, on the other hand, focus on reward for skills and performance, with the work force sharing in company profit or loss. One core belief of new compensation policies is that as employees become employee owners, they are likely to work harder to ensure the success of the company. Indeed, programs that promote employee ownership-and thus employee responsibility and emotional investment-are becoming increasingly popular. Examples of these types of programs include gain sharing, in which employees earn bonuses by finding ways to save the company money; pay for knowledge, in which compensation is based on job knowledge and skill rather than on position (and in which empl oyees can increase base pay by learning a variety of jobs); and incentive plans such as employee stock options plans (ESOPs). Compensation programs and policies must be communicated clearly and thoroughly to employees. Employees naturally want to have a clear understanding of what they can reasonably expect in terms of compensation (both in terms of monetary compensation and benefits) and performance appraisal. To ensure that this takes place, consultants urge business owners to detail all aspects of their compensation programs in writing. Taking this step not only helps reassure employees, but also provides the owner with additional legal protection from unfair labor practices accusations. Todays competitive business environment is forcing companies to rethink how to attract and retain top talent without sacrificing business goals. Employee compensation and benefits are an employers primary tools to attract and retain talented employees, but they are facing more scrutiny now than ever. Plan fiduciaries are under increased pressure to adhere to rigid standards in light of recent corporate scandals. Waves of employee benefits legislation and regulation threaten to swamp employee benefit plan administration. Many companies are faced with unmotivated employees whose poor attitude can greatly affect the growth of the company. By introducing incentives, companies can boost employee morale tremendously. A few examples of employee incentives are paid vacations, company sponsored social activities, stock options, and bonuses or pay increases based on performance. Based on the inputs the HRM can prepare the fair compensation policy, which enables the company to reach better performance. The HRM is responsible for the correct setting and keeping the rules during the procedure of creation of the fair compensation policy. The fair compensation policy means the fair value of each job in the organization and clear process of reaching this fair value. Transparent Compensation Policy is about opening the rules for the compensation policy to employees. When the employees have a chance to understand the principles of the compensation policy and they can take them as fair to them, you are successful in the implementation of the Transparent Compensation Policy. Proportionality exists as a ground for setting aside administrative decisions in most continental legal systems and is recognised in UK cases where issues of European Community law and ECHR is involved, it seems logical that the treatment becomes the standard of substantive review in all cases. A significant criticism of the Wednesbury criteria is that they do not allow for the effect on the life of the individual involved to be judged.Just because a judgement is not so unreasonable as to be incomprehensible does not mean that it is not disproportionately devastating for the affected individual – for example, when resources are scarce, it may not be irrational for a local authority to discharge their statutory duties under the 1996 Housing Act by offering housing in an area where it is cheap, but the effects on the lives of e. g. a person who has become homeless who is only offered accommodation a long way from good employment prospects, may be enormous.In such cases, the prop ortionality test would reveal that a general policy intended to conserve resources would in fact cause the individuals affected to consume more resources. The state and thus administrative decisions enter into so many areas of the lives of individuals that the idea of bifurcation – using proportionality where â€Å"fundamental rights† are concerned and the Wednesbury test in all others – is disingenuous at best. In areas such as asylum support or housing, it is immensely complex to distinguish the point at which mere â€Å"interests† end and â€Å"fundamental rights† begin.It is both simpler and more logical to assume the same standard for all issues of judicial review. It is also notable that the Wednesbury test is, by its very nature, a less transparent methodology than proportionality – there are a number of significant cases, such as Wheeler v Leicester City Council, where decisions have been overturned on grounds of irrationality withou t substantive reasons being given as to why â€Å"no reasonable judge could make this decision,† – which must, by its very nature, be on some level subjective.That is not possible with proportionality, where all aspects must be laid out and considered in turn as a basic fact of the methodology. The Wednesbury test comes under further criticism when we consider the significantly narrow scope for intervention. The case of Short v Poole Corporation (1926) Ch 66 at 90-91 is the well documented example of the red haired teacher dismissed because she had red hair. This case proved that decision makers can act unreasonably and reach the wrong decision but they can't exercise their power so unreasonably that no other body would have reached that decision.This was an extreme case of unreasonableness where lord Greene's principle could easily be applied however there are a large number of other cases where intervention is not so accessible. Le Sueur (2004) highlights that Wednes bury principle is only appropriate in the most extreme circumstances and does not allow for a varied intricate subject matter. Lord Walker (2007) in the case of R (Pro-life Alliance) v BBC appeal highlighted that the advantage of the Wednesbury test is simplicity.However, when it comes to human rights – a complex matter – ‘a one size fits all' test is nothing short of being unsatisfactory. The Wednesbury principle was adopted in the Australian case Parramatta City Council v Pestell (1972) It was concluded that the court had considered irrelevant matters and not considered matters that it should have. As Lord Bingham in the case of R(SD) v The Governors of Denbeigh High School[2007] 1 AC 100, para 30 â€Å"†¦ t is clear that the court's approach to an issue of proportionality under the Convention must go beyond that traditionally adopted to judicial review in a domestic setting† In Smith ;amp; Grady when â€Å"applying the conventional Wednesbury principles of judicial review (adapted to a human rights context) the judge found that, although the justifications may have seemed to many to be unconvincing, the policy was not â€Å"outrageous in its defiance of logic† and, accordingly, not unlawful. † However the European Court of Human Rights found it to be in breach of multiple articles of the convention o f human rights.Smith and Grady is an example of how many claimants now rely on both domestic law and HRA grounds of review. A key case in the propagation of proportionality is The House of Lords in R (Daly) v. Secretary of State for the Home Department (2001) 2 AC 532 demonstrated how the traditional test of Wednesbury unreasonableness has moved towards the doctrine of necessity and proportionality. In October 1963, Kennedy had decided to withdraw one thousand military advisers from the region by end of the year. Kennedy Calls for the Withdrawal of US Military Advisers The day before Kennedy was assassinated, he had approved National Security Action Memorandum (NSAM) 263 which expressly called for the withdrawal of these U.S. military advisers. However, with the succession of Lyndon B. Johnson to the presidency, the final version of this bill was changed. The version officially approved by President Johnson, NSAM 273, left out the withdrawal of advisers by the end of 1963. By the end of 1965, over 200,000 U.S. combat troops were in Vietnam. Furthermore, by the time the Vietnam Conflict ended, there were over 500,000 troops deployed with more than 58,000 casualties.   There are some conspiracy theorists that solely look to the difference in policy towards U.S. military presence in Vietnam between Kennedy and President Johnson as the reason for Kennedys assassination. However, there is little evidence to support this theory.   In fact, during an April 1964 interview, Bobby Kennedy answered a number of questions about his brother and Vietnam. He stopped short of saying that President Kennedy would not have used combat troops in Vietnam.    Camelot and Kennedy The term Camelot evokes thoughts of the mythical King Arthur and the Knights of the Round Table. However, this name has also become associated with the time that Kennedy was president. The play, Camelot was popular at the time. It, like Kennedys presidency, ended with the death of the king. Interestingly, this association was created soon after his death by Jackie Kennedy herself. When the former First Lady was interviewed by Theodore White for a Life magazine piece that appeared in a December 3, 1963, special edition of the publication, she was quoted as saying that, â€Å"There will be great presidents again, but there will never be another Camelot.†Ã‚   Although it has been written that White and his editors did not agree with Jackie Kennedy’s characterization of Kennedy’s presidency, they ran the story with the quote. Jackie Kennedys words encapsulated and immortalized John F. Kennedy’s few short years in the White House. The 1960’s after Kennedys assassination saw major changes in the United States. There was a growing degradation of trust in our government.   The way that the older generation viewed the youth of America was changed, and the limits of our Constitutional freedom of expression were severely tested. America was in a period of upheaval that would not end until the 1980s.
